Worker’s Compensation Carriers Must Protect the interests of Medicare when Settling Claims
Legislation has required worker’s compensation carriers to protect the interests of Medicare when settling claims. In order to protect Medicare, an appropriate amount of settlement money must be set-aside for the payment of future medical costs in relation to the injury.
Under the legislation, any entity found to be not protecting Medicare interests in future medical costs can be held liable for double damages.
